Variations in the form of additions, omissions or substitutions to the scope of construc- tion works in construction contracts are necessary because no project is impeccable and changes are required to meet unforeseen circumstances or changed require- ments. Disputes due to conflicts and disagreements about the construction works variations are common which usually lead to progress payment problems, and if the disputes can not be resolved in time, unnecessary work stoppage, time-lost and cost-overrun may ensue. In Singapore, adjudication process under the Security of Payment Act is one such dispute resolution framework to enable the affected con- tracting party to settle the progress payment matters fast and cost effective without having to resort to cumbersome, expensive and long drawn legal proceedings.
This short course is structured through lectures and case studies to enhance the learning experience. The participants will learn through this short course about the nature of contract terms, standard forms of contract, variations, the Security of Payment Act Regulatory Framework and court case judgments.
